Bangalore Committee to look into loopholes in the “THO” Act

A three-member committee has been constituted in Bangalore to take a closer look at the loopholes in the "Transplantation of Human Organs" Act, with special emphasis on the section that deals with organ donation from liver unrelated donors. Chapter II, subsection (3) of section 9 states, "If any donor authorizes the removal of any of his human organs before his death under subsection (1) of section 3 for transplantation into the body of such recipient, not being a near relative as is specified by the donor by reason of affection or attachment towards the recipient or for any other special reasons, such human organ shall not be removed and transplanted without the prior permission of the Authorisation Committee."

According to Lok Ayukta, Director (Vigilance), Dr. H. Sudarshan, "It was financial inducement that resulted in unrelated transplants and not because of any sort of affection or attachment towards the recipient, as is required by the Act." Of the 1000 plus recorded cases of unrelated organ transplants that were put up for approval before the State Authorisation Committee between 1995 and March 2002, only 22 were rejected with the law providing for organ donation for reasons of "affection or attachment" or "for any other special reason" it was reasonable to assume that money had changed hands, although not always easy to prove. The committee will review the existing section of the Act and look at ways of strengthening the implementation of the law making suitable amendments in the provisions of the law and allied issues.

The members include National Law School of India University, Director, Mr. Mohan Gopal, Bangalore Kidney Foundation, Medical Director, Dr. Venkatesh Murthy, and Dr. H. Sudarshan.
